Terms of Service (AGB)

These Terms of Service (AGB) govern the use of the Nomado24 job-board platform, operated by Nomado24 UG (haftungsbeschränkt).

§ 1 Scope

1. These Terms apply to all users of the Nomado24 platform (www.nomado24.de), regardless of whether they are registered as applicants, companies or administrators.
2. By registering for or using the platform, you accept these Terms.
3. Deviating terms of the user are not recognized unless we expressly agree to their validity.

§ 2 Description of Services

1. Nomado24 is an online platform for location-independent and remote-friendly work.
2. In particular, the platform enables:
   • Companies to publish job advertisements
   • Applicants to search for job openings and submit applications
   • Communication between applicants and companies
   • Browsing and booking coworking spaces
   • Participation in a community forum for exchange between users
   • Use of an AI-powered career assistant (AI Advisor) for general information purposes
3. Bookings of coworking spaces may be subject to charges. Payment processing is handled by the payment service provider Stripe; its terms apply in addition.
4. The responses of the AI-powered career assistant are generated automatically, serve general information purposes only and do not constitute legal, tax or immigration advice. No guarantee is given for their accuracy or completeness.
5. Nomado24 does not act as an employer or employment agency within the meaning of the German Social Code III (SGB III), but merely provides the technical platform.

§ 2a Coworking Marketplace

1. Through the coworking marketplace, Nomado24 brokers bookings of coworking offers. The contract for the coworking service is concluded directly between the user and the respective operator of the offer; Nomado24 does not become a party to that service. Payment is processed via the payment provider Stripe.
2. The total price payable, including any applicable statutory VAT, is shown during the booking process before the booking is completed. Nomado24 may receive a commission or service fee from the operator for the brokerage; this does not create any additional cost for the booking user beyond the total price shown.
3. Cancellation and refunds are governed by the operator's conditions displayed with the respective offer. Mandatory statutory rights of the user remain unaffected.
4. The order in which coworking offers are displayed (ranking) follows, in the default "Recommended" sort, the relevance to the search query and the selected filters (including location, city, capacity and price) as well as the offer's rating and recency. Users can change the sorting themselves, for example by price or by distance from a chosen location. No preferential placement in exchange for payment (paid placement) takes place.
5. Business users (operators) may address complaints relating to the coworking marketplace to the email address stated in the imprint. Nomado24 handles such complaints promptly and communicates the outcome to the operator.

§ 3 Registration and User Account

1. Use of the platform requires registration.
2. Complete and truthful information must be provided during registration.
3. The user is obliged to keep their access credentials confidential and to protect them from unauthorized access.
4. Each user may create only one user account.
5. Transferring the user account to third parties is not permitted.

§ 5a Right of Withdrawal for Digital Services

1. For contracts for digital services concluded online, consumers are generally entitled to a statutory 14-day right of withdrawal.
2. We do not require you to waive your right of withdrawal in order to take out a paid subscription. The service may be provided immediately after the contract is concluded; your 14-day right of withdrawal remains unaffected.
3. If you exercise your right of withdrawal in time, within 14 days, we will refund the amount already paid in full. You can also end your contract at any time via the cancellation button.

§ 6 Liability

1. Nomado24 is liable without limitation for intent and gross negligence.
2. In cases of slight negligence, Nomado24 is only liable for breaches of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable damage typical for the contract.
3. Responsibility for the accuracy, completeness and currency of job advertisements lies exclusively with the publishing companies.
4. Nomado24 accepts no liability for:
   • The content of job advertisements
   • The content of application documents
   • The conclusion of employment contracts
   • Disputes between users
5. Liability under the German Product Liability Act remains unaffected.

§ 7 Data Protection

Personal data is processed in accordance with ourPrivacy Policyand the applicable data protection regulations.

§ 8 Termination and Suspension

1. Users may delete their account at any time without giving reasons.
2. Nomado24 may suspend or delete user accounts in the event of violations of these Terms.
3. In the event of serious violations (e.g. criminal offences, repeated violations), Nomado24 may terminate the user account without notice.
4. After termination of the user relationship, personal data will be deleted in accordance with the Privacy Policy.
5. An existing Pro subscription can be cancelled at any time effective at the end of the billing period already paid for — either in the account settings or via the publicly accessible cancellation button at /kuendigung (no login required). Cancellation takes effect at the end of the current billing period; the account itself remains unaffected.

§ 9 Copyright and Usage Rights

1. All content on the platform (design, texts, graphics, code) is protected by copyright.
2. By uploading content (job advertisements, application documents), users grant Nomado24 a non-exclusive, worldwide right of use to the extent required for operating the platform.
3. Commercial use of the platform or individual content without consent is prohibited.

§ 10 Changes to these Terms

1. Nomado24 reserves the right to amend these Terms.
2. Users will be notified of changes by email at least 4 weeks before they take effect.
3. If the user does not object to the amended Terms within 4 weeks of receiving the notification of changes, the amended Terms are deemed accepted.
4. In the event of an objection, the user relationship ends upon expiry of the objection period.

§ 11 Final Provisions

1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
2. The place of jurisdiction is Frankenthal, to the extent legally permissible.
3. Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
